Agreement to These Terms

These Terms and Conditions ("Terms") govern your access to and use of the GolfTracker website, registration system, and related services (together, the "Services"). By using the Services, registering for an event, purchasing a sponsorship, or creating an account, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility and Accounts

• You must be at least 18 years old to register for an event or create an account.
• You agree to provide accurate, current information and to keep it up to date.
• You are responsible for activity that occurs under your account and for keeping your credentials confidential.
• Notify us promptly if you believe your account has been accessed without your authorization.

Registration, Fees, and Payment

• Registration is confirmed only when payment is received and you receive a written confirmation.
• Prices are listed at the point of purchase and are stated in U.S. dollars.
• Payments are processed by Stripe. We do not receive or store your full card details.
• Entries and sponsorships may be limited. Where an event sells out, we may maintain a waitlist.
• You are responsible for any taxes that apply to your purchase.

Cancellations and Refunds

• Refund eligibility and deadlines are stated on the registration or sponsorship page for each event. Those event-specific terms control.
• Where no event-specific policy is stated, registrations are non-refundable but may be transferred to another participant with advance written notice.
• If an event is cancelled by the organizer and not rescheduled, paid participants will receive a refund or a credit, at the organizer's election.
• Play suspended or shortened due to weather, course conditions, or other circumstances outside the organizer's control does not by itself create a right to a refund.

Sponsorships

Sponsorship benefits, placement, and deliverables are described in the applicable sponsorship tier. Sponsors are responsible for supplying usable logo and creative files by any stated deadline. We may decline or discontinue a sponsorship that conflicts with venue rules, applicable law, or the character of the event, and will refund amounts paid for benefits not delivered in that case.

Conduct at Events

• Participants must follow the rules of the host golf course, all posted safety instructions, and the directions of event staff.
• We may remove any participant whose conduct is unsafe, abusive, or materially disruptive, without refund.
• Participants are responsible for damage they cause to the venue, carts, or equipment.

Assumption of Risk

Golf involves inherent risks, including being struck by a ball or club, cart-related injury, uneven terrain, wildlife, and heat-related illness. By participating you acknowledge these risks and accept them voluntarily. You are responsible for determining that you are physically fit to participate.

Photography and Media

Photographs, video, and live-scoring information may be captured at events and used for recaps, sponsor reporting, and promotion. By attending, you consent to that use. If you do not want your likeness used, tell event staff at check-in and we will make reasonable efforts to honor the request.

Acceptable Use

You agree not to:

• Use the Services in violation of any applicable law or regulation.
• Attempt to access accounts, data, or systems you are not authorized to access.
• Interfere with, overload, probe, or disrupt the Services or their infrastructure.
• Scrape, harvest, or resell data from the Services, including participant or sponsor information.
• Upload malicious code or content that is unlawful, infringing, or harassing.

Text Messaging

If you opt in to SMS, message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for assistance. Our handling of SMS data is described in our Privacy Policy.

Intellectual Property

The Services, including their software, design, text, and graphics, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services without our written permission. Sponsor and participant marks remain the property of their respective owners, who grant us a limited license to display them in connection with the event.

Third-Party Services

The Services rely on third parties, including Stripe for payments and messaging and analytics providers. Their terms and privacy practices govern their own services, and we are not responsible for their acts or omissions. Links to third-party sites are provided for convenience and are not endorsements.

Availability

We aim to keep the Services available and accurate, but we provide them on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, and we disclaim all implied warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of your use of the Services or attendance at an event. Our total liability for any claim relating to the Services or an event will not exceed the amount you paid to us for the registration or sponsorship giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless GolfTracker, its organizers, staff, volunteers, sponsors, and the host venue from claims, damages, and expenses, including reasonable attorneys' fees, arising out of your use of the Services, your conduct at an event, or your violation of these Terms.

Termination

We may suspend or terminate access to the Services at any time if you violate these Terms or if we reasonably believe your use creates risk or legal exposure. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be posted on this page, and your continued use of the Services after a change takes effect constitutes acceptance.

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. You agree that the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction over any dispute arising out of these Terms or the Services.
